TERMS AND CONDITIONS

CONCLUSION OF SALES CONTRACTS:

The confirmation and sending of the order by the customer (the "Customer" means the user of the layris.com website who accesses the e-commerce checkout), according to the instructions that will appear on the pages from time to time web entails the Customer's having read and fully accepted these general conditions of sale. The sales contract between layris.com and the Customer is considered finalized with the acceptance of the order by layris.com. If the Customer is a consumer (a natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number in the order form), once the online purchase procedure has been completed, will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of article 3 and 4 of Legislative Decree 185/99 on distance selling. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for non-acceptance, even partial, of an order. article 2 conditions of sale

PURCHASE METHOD

The Customer can only purchase the products present in the online catalog at the time of placing the order and viewable online at layris.com as described in the relevant information sheets. The order will be validly processed upon receipt in the email address communicated by the Customer of the confirmation of the authorization to charge the Customer's credit card of the price and any costs for transport and delivery, as better provided for in the subsequent art.5. The image accompanying the description of a product may not be perfectly representative of its characteristics but may differ in colour, dimensions and accessory products present in the figure. All purchase support information (Glossary, Purchasing Guide, etc.) is to be understood as simple generic information material, not referable to the real characteristics of a single product. The correct receipt of the order is confirmed by layris.com through an email response, sent to the email address communicated by the Customer. This confirmation message will contain the Date and Time of receipt of the order and a Customer order number to be used in any further communication with layris.com. The message presents all the data entered by the Customer, all information relating to the essential characteristics of the goods, the indication of the price, payment methods, delivery methods and costs and applicable taxes. The Customer must verify its correctness and promptly communicate any corrections, according to the methods described in this document. In the event of non-acceptance of the order, layris.com guarantees timely communication to the Customer

PRICES

The products will be sold at the prices, including VAT, indicated in the online product sheet at the time of order confirmation by the Customer. Delivery costs may be borne by the Customer and will possibly appear on the "order summary" web page. Before the customer confirms the order by clicking on the appropriate button, a summary of the prices of the products loaded on the cart and the delivery costs will appear on the web page. These data will then be automatically reproduced in the order form that the customer sends to layris.com following the order confirmation procedures.

ACCOUNTING DOCUMENTATION AND DELIVERY METHODS

For each order accepted and placed, layris.com issues a receipt for the material shipped, sending it via e-mail to the order holder, pursuant to art. 14 Presidential Decree 445/2000. For the issuing of the tax receipt, the information provided by the Customer at the time of the order is valid. No changes to the tax document will be possible after it has been issued. No responsibility can be attributed to layris.com in the event of a delay in processing the order or in delivering what was ordered. The delivery costs of the products are entirely borne by layris.com. There are no minimum spending amounts necessary to obtain free shipping.

TERMS OF PAYMENT

The Customer can only make payment by credit card, Pay Pal, bank transfer. At the same time as the order is placed by the Customer, the relevant banking institution will authorize and charge the amount relating to the order placed on the Customer's credit card. In the event that the Customer exercises the right of withdrawal, in the manner defined in the following, layris.com will return the amount previously charged directly to the customer's credit card or PayPal account, excluding shipping costs already incurred. At no time during the purchase procedure is layris.com able to know the information relating to the Customer's credit card, transmitted via a protected connection directly to the website of the banking institution that manages the transaction and no computer archive of layris.com will retain such data.

RIGHT OF WITHDRAWAL

Pursuant to art. 5 DL 185/1999, if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a Lot reference in the layris.com order form VAT), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, without prejudice to what is indicated in point 6.3 below. To exercise this right, the Customer must send layris.com a written communication in in this sense, within 10 working days from the date of receipt of the goods. This communication must be sent by e-mail to info@layris.com.

Once the aforementioned notice of withdrawal has been received, the layris.com Customer Service will quickly communicate to the Customer the instructions on how to return the goods which must reach layris.com within 10 days of authorization.

The right of withdrawal is however subject to the following conditions:

the right applies to the product purchased in its entirety

the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation, etc...)

In all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided

the shipping costs relating to the return of the goods are borne by the Customer

the shipment, until receipt is certified in our warehouse, is under the complete responsibility of the Customer

In the event of damage to the goods during transport, layris.com will notify the Customer of the incident (within the 5th working day of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain reimbursement of the value of the property (if insured); in this case, the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request; layris.com is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments; upon arrival (in the warehouse), the product will be examined to assess any damage or tampering not resulting from transport. If the package and/or the original packaging are damaged, layris.com will deduct a percentage from the refund due, in any case not exceeding 10% of the same, as a contribution to the restoration costs.

Without prejudice to any restoration costs for confirmed damage to the original packaging, layris.com will refund the Customer the entire amount already paid, excluding shipping costs, within 14 days of the return of the goods. The refund operation will be carried out by layris.com by crediting the amount due, which will be paid to the credit card

The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where layris.com ascertains:

the lack of the external packaging and/or the original internal packaging

the absence of integral elements of the product (accessories, parts, ...)

damage to the product for reasons other than its transport

in the event of forfeiture of the right of withdrawal, layris.com will return the purchased good to the sender, charging the shipping costs to the sender.

WARRANTY AND COMPLAINTS

All layris.com products sold by layris.com are covered by the manufacturer's conventional warranty and by the 24-month warranty for defects of conformity, pursuant to Legislative Decree 206/05. To benefit from warranty assistance, the Customer must keep the tax receipt or invoice (or DDT) that he will receive via e-mail in electronic PDF format. The exercise of the Warranty may include requesting assistance from authorized assistance centers present in the area and/or following the methods illustrated in the documentation inside the product packaging. The manufacturer's conventional warranty is provided according to the methods illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Assistance Centre, the defect is found not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration requested by the Authorized Assistance, as well as transport costs, if supported by layris.com. The 24-month warranty pursuant to Legislative Decree 206/05 applies to the product that presents a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number reference in the order form). In case of lack of conformity, layris.com. provides, at no cost to the Customer, to restore the conformity of the product through repair/replacement or to reduce the price, until the contract is terminated. If, following intervention by an Authorized Assistance Centre, the defect does not result in a lack of conformity pursuant to Legislative Decree 206/05, the Customer will be charged for any costs of verification and restoration requested by the Authorized Assistance, as well as shipping costs if supported by layris.com. Replacements in the event of DOA (Dead On Arrival: product not functioning upon delivery) take place only if expressly provided for by the manufacturer. The timing of replacement or possible repair of the product depends exclusively on the manufacturer's policies. In the event that, for any reason, layris.com is unable to return a product under warranty to its customer (restored or replaced). may proceed at its own discretion with the refund of the amount paid taking into account the use of the goods or with its replacement with a product of equal or superior characteristics. The times for repairs or possible replacement of the product depend exclusively on the manufacturer's policies and no damage can be requested from layris.com for any delays in carrying out repairs or replacements. In cases where the application of the guarantees requires the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend placing it in a second box; In all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided. The Customer will be provided with a product return authorization number (RMA) which must be indicated on the outside of the packaging, following the instructions provided directly in the relevant authorization email. APPLICABLE LAW AND JURISDICTION

This contract is regulated by the Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this Contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his Municipality of residence; in all other cases the territorial jurisdiction is exclusively that of the headquarters of layris.com.
